Legal requirements
Passport
Just like your guests, you and your partner need to have a valid passport. A fundamental requirement for any foreigner to enter Spain.
Birth certificate
For foreign citizens to be able to get married in Spain, it is necessary to present a copy of their birth certificates, translated into Spanish by a sworn interpreter and duly legalized or apostilled, depending on the country of origin. This document is essential for the Civil Registry in Spain to confirm that all marriage requirements are met.
The apostille or legalization ensures that the birth certificate is legitimate and internationally recognized. In countries that are part of the Hague Convention, the apostille is sufficient; otherwise, the certificate must be legalized at the Spanish embassy or consulate in the country where it was issued.
Registration
For foreigners who want to get married in Spain, the registration certificate must be valid, that is, with an issue date no more than 3 months old, and serves to confirm the place of residence of the foreign couple for the last two years:
If the couple has lived in Spain during that time, the registration must be processed in the town hall corresponding to their municipality of residence.
If the couple has resided outside of Spain, then they must request the certificate through the consulate in Spain of the country in which they have resided during that period.
Witnesses
The foreign couple must have at least two witnesses. Their role is to attest to and confirm the legality and veracity of the marriage union.
These witnesses must be of legal age, present themselves on the day of the ceremony, and bring with them both the original and a photocopy of their valid identity document. They can be relatives or friends of the couple, and in certain cases it is not necessary for them to be registered as residents in Spain or to have Spanish nationality.
Certificate of marital capacity
The certificate of marital capacity confirms that a foreign person meets the legal conditions necessary to marry under Spanish law. This document must be processed individually by each member of the couple in their country of origin or at the corresponding consulates in Spain. The requirements to obtain this certificate vary depending on the country. Once issued, both certificates must be translated into Spanish by a sworn interpreter and subsequently legalized for validity in Spain.
Apostille
Apostille is a process of authenticating foreign documents that guarantees their validity in other countries that are part of the Hague Convention (of 1961), such as Spain.
In order for you and your partner, as foreigners, to be able to get married in Spain, you must present certain essential documents such as your birth certificates and certificates of marital capacity. These documents, issued in your countries of origin, must be apostilled in order to be legally recognized in Spain.
Apostille is carried out in the country that issues each document and is generally carried out by authorities such as the Ministry of Justice, notary offices, or courts, depending on the country. Once apostilled, these documents must be officially translated into Spanish (by sworn interpreters) if they are in another language.
